IS KRATOM LEGAL IN ARIZONA?

Kratom or Mitragyna speciosa is a plant indigenous to Southeast Asia where it has been used for centuries. In the US, the leaf of the plant is turned into a powder which is brewed as teas or eaten raw in the form of pills and capsules or even vaped. Some have also used it to wean themselves off the more dangerous opioids as it lessens the withdrawal symptoms. Though most people use it as a relief to chronic pains, coughs, diarrhoea, to enhance the mood and to reduce fatigue.

The little research done in this area suggests that it targets the areas of the brain that responds to opioids. If you are buying kratom for the first time, you must know that it comes in three varieties, red, white and green. Each of these varieties produces a different effect on the body due to different alkaloids present within its leaves. The veins and the stems have this colour and can be easily identified by looking at the leaf. However, the stems and the veins are crushed along with the leaf when they turn it into a powder.

The Federal government is still wondering about how to define the legal status of kratom and states are supposed to fill up this lacuna in the legal field by bringing in their own laws.

Kratom Legality In Arizona?

Arizona, like most other states in 2014, first tried to ban kratom through HB2453. They wanted to add kratom to the bill as a synthetic substance but kratom is a 100% natural plant product and it was dropped out before the bill was passed. This also was made possible due to the immense support shown by the kratom supporters in Arizona who petitioned against this bill.

The DEA (Drug Enforcement Administration) in 2016 intended to classify kratom as a Schedule I drug and put it into the category with other dangerous opioids like LDS, heroin, cocaine, etc. But quickly withdrew their claim in response to a major backlash from the public in the same year. Their withdrawal statement says that they are doing research to find more information on kratom.

The DEA is mostly concentrating on the deaths related to kratom and is searching for reasons where they can scientifically prove that it has no medicinal value and has a high potential for abuse. But as research is still ongoing since 2016 and there have been no moves from them to reclassify kratom, it seems fair to say that they shall soon permit it on the federal level.

The FDA however in 2018 almost banned kratom after many batches of it from vendors were found to be contaminated with Salmonella and resulted in multi state infections. They have since advised consumers of kratom to avoid all such products. The CDC (The Center for Disease Control and Prevention) also reported in 2019 of 15 deaths that happened from 2014 to 2016 that involved the use of kratom though with other substances. So, again these cases were not due to only kratom and so again these cases do not prove with incriminating evidence that kratom is the culprit.

In 2019, Arizona through HB2561 more famously known as the Kratom Consumer Protection Act legalised kratom for individuals over 18 years of age all over the state. This regulates the sale, production, labelling, usage, processing, etc. of the entire kratom business for the vendors as well as provides a legal and safe environment for the consumers.
